Canadian judge hears $19B Ecuador lawsuit case

TORONTO (AP) ? An attempt by Ecuadorian villagers to have a Canadian court enforce a $19 billion judgment awarded in their country against multinational oil giant Chevron Corp. faced a judge's skepticism Thursday.

Ontario Superior Court Justice David Brown heard arguments on Chevron's motions to challenge jurisdiction but wondered whether he could issue a ruling since an appeal is pending in Ecuador's constitutional court. He also said the case should be heard in the U.S., not Canada.

The award to the villagers was made in Ecuador for black sludge contamination of a rainforest between 1972 and 1990 by Texaco, which Chevron Corp. bought in 2001. U.S.-based Chevron Corp. maintains it won't pay because it says Texaco dealt with the problem before it was bought.

The villagers want the judgment enforced in Canada, arguing that Chevron Canada has billions of dollars' worth of assets.

After filing suit in Canada in May, the villagers launched similar legal actions in Argentina and Brazil. Earlier this month, a judge in Argentina froze Chevron's assets there until the $19 billion is collected.

Foreign judgments are enforceable in Canada as long as there is a "real and substantive connection" between the foreign jurisdiction and the subject matter of the claim, the Supreme Court of Canada has ruled.

However, Chevron Corp. lawyer Alan Mark argued Thursday that the case had no cause against subsidiary Chevron Canada since the judgment was against the parent company, whose subsidiaries largely operate independently.

Fellow Chevron lawyer Clarke Hunter argued that the Canadian units operate with an independent board separated from the U.S.-based parent by several levels of ownership and that none of the boards or management related to the case is in Canada.

"There is no other connection to Ontario but for the claim that the assets of Chevron Canada Ltd. are the assets of Chevron Corp," Mark said.

The hearing resumes Friday.

New Florida License Plates: Five Alternative Nominees

Your Florida license plate is about to become a collector's item. The venerable image of the orange and the words Sunshine State will soon be replaced by a new model. Starting this week, Floridians can vote online for their favorite new look. Unfortunately, the options provided by the DMV are more boring than driving the Turnpike.

So we thought we'd design some alternative options that represent our great state even better than the iconic orange. Vote for your favorite at miaminewtimes.com!

Design 1: "Florida: The Oxycodone State." Florida's economy is pretty simple: We get money from tourism, fishing, exorbitant highway tolls, and a running subsidy from America's Funniest Home Videos to supply the TV show with 50 percent of its content. But in South Florida, pill mills are still king. So why not honor their role in boosting the state economy? We'll even snag a motto from Road House: "Pain don't hurt."

Design 2: "Florida: America's Geriatric Alamo." Florida is chock full of two things: deadly weapons and people close to death. The elderly outnumber the rest of the state's population by roughly 40,000 to 1, and there are enough guns here to supply the world's militaries for a year. This license plate unites what are essentially the state's two mascots: old people and firearms.

Design 3: "Florida: The Hold-Your-Breath-on-Election-Night State." Admit it. It was pretty funny watching the rest of the country have an aneurysm as it feared Florida would again decide the presidential race. Our ignominious voting history is one Florida's defining traits. Let's celebrate our inability to master the insanely complicated task of filling in bubbles on a piece of paper with this plate, featuring a ballot being thrown into the garbage. Just know that your vote for this design will probably be lost or left in a box in a Broward elections office.

Design 4: "Florida: Cuba's 16th Province." In the rest of the United States, there aren't enough Cubans to start a baseball team. In Miami, there are so many cubanos you could form your own league. To that end, we commemorate our role as Latin America's Taiwan and stick it to Fidel in the process.

Design 5: "Florida: Proud Home of Bat Boy." You might have noticed that our governor, the esteemed Richard Scott, bears a passing resemblance to a certain supermarket tabloid icon. Bat Boy ? or to use his full name, Batthew Boy ? has been busy these past 20 years. He has terrorized children, run for governor in California, helped U.S. forces find Saddam Hussein, and bitten Santa Claus. But in his old age, he has retired to Florida to become an incompetent public official, and it's high time we honor him.

Governor Quinn Announces Successful Community Transition for ...

Historic Milestone for Improving the Lives of Individuals with Developmental Disabilities and Mental health Challenges in Illinois

SPRINGFIELD--(ENEWSPF)--November 29, 2012. Governor Pat Quinn today announced that the remaining residents at the Jacksonville Developmental Center (JDC) have transitioned to community care. The moves are part of the governor?s rebalancing initiative to increase community care options for people with developmental disabilities and mental health challenges while reducing the number of outdated institutions in Illinois.

?Today is a historic step forward in our effort to improve the quality of life for citizens with developmental disabilities and mental health challenges in Illinois," Governor Quinn said. "I thank all of the family members and committed advocates who worked together to make this transition safe and responsible. I am committed to strengthening community care in Illinois and helping to ensure that all people have an opportunity to reach their full potential."

?Numerous studies show that individuals living in the community have a better quality of life than those living in institutions,? said Illinois Department of Human Services (IDHS) Secretary Michelle R.B. Saddler. ?The closure of JDC is major progress for Illinois and how our state cares for people with developmental disabilities. I would like to commend the governor for his extraordinary leadership and thank our many advocates for their continued support on this important issue."

Each JDC resident went through a thorough, person-centered planning process, including assessment, consultation with families and guardians, and planning sessions with providers to determine needs and ensure safe transitions. Community settings allow individuals to receive the care they need, including 24-hour care. Community care is also significantly less costly than institution-based care. The average cost for JDC was $200,000 per year per resident while the average cost for a JDC resident living in the community is $84,000 per year.

JDC currently costs the state approximately $27.9 million per year to run. After accounting for state costs under community care, Illinois will realize approximately $11.7 million per year in savings, after $16.2 million in community investment. All AFSCME employees were offered other positions within state government. Of the 310 AFSCME employees at JDC, 130 filled positions at IDHS and other state agencies, eight decided to retire and 172 employees chose the layoff option.

In 2011, Governor Quinn announced his commitment to rebalance Illinois? use of institutionalization for the care of people with developmental disabilities and provide more community care options. Illinois has lagged behind the rest of the nation in the utilization of person-centered, community-based care. Community-based care has been proven to empower people with developmental disabilities to lead more active, dynamic lives. The governor's Rebalancing Initiative dovetails with the administration?s recent settlement of a series of court cases related to the Americans with Disabilities Act, requiring the expansion of community care settings.

With muted enthusiasm, CEOs tell Obama they'll pay higher taxes

President Obama's sit down session with 14 chief executives on Wednesday afternoon went swimmingly. At least from the Obama administration's point of view it did. Everybody at the meeting -- including Yahoo CEO Marissa Mayer and Goldman Sachs chief Lloyd Blankfein -- behaved themselves and did their best not to look bored in the obligatory White House photographer photo that made its way to Flickr in no time. (See above.) But most importantly, Obama got the headlines he wanted.

It's extraordinary, really. Less than a month after trouncing Republican candidate Mitt Romney -- an open-minded fellow who stopped by the White House for lunch a couple hours before the big CEO summit -- Obama managed to get some of the wealthiest men and women in the country to offer their tacit support for his raising taxes. "At White House, CEOs offer support for higher tax rates," reads Reuters' headline. "Business chieftains back Obama approach," says the conservative Washington Times. From a 30,000-foot vantage point, CNN went with "GOP divide over Obama tax plan goes public."

So the fiscal cliff debates are over now, right? Well, let's not get ahead of ourselves. Obama's meeting with CEOs and Wednesday was just one of many the president's been having with business leaders, union leaders and progressive leaders. (Lots of leaders.) And while a few news organizations gave the meeting a positive spin, the power brokers in Wednesday's meeting didn't exactly sound enthusiastic about an imminent tax hike. "The president and his team were resoundingly reasonable in what they had to say," said Marriott CEO Arne Sorenson. "There needs to be some revenue element to this, and [Obama] started with rates," said Joe Echevarria, chief executive of Deloitte. And he started with rates on what we would define [as] the upper two percent. ... That we have to pay our fair share. And I think everybody was in agreement with that notion."?

Muted enthusiasm is about the best Obama could ask for. Winning support for his new tax plan is no easy challenge, and the president probably won't get any more freebies, like the one that Warren Buffett served up earlier this week with his "minimum tax for the wealthy" op-ed in?The New York Times. Let's just hope that Lloyd Blankfein doesn't get too carried away with doing the math. So far, the Goldman chief very surprisingly seems on board. After the meeting, Blankfein actually called the president's plan for avoiding the fiscal cliff "very credible." That's a big deal.

Movado sets 75-cent special dividend, ups guidance

PARAMUS, N.J. (AP) ? Movado Group Inc. on Wednesday announced a special cash dividend, the latest in a string of companies to set one-time payments before the end of the year, and lifted its guidance for the year after a strong fiscal third quarter.

Shares rose $1.79, or 5.6 percent, to $34.02 in premarket trading.

The Paramus, N.J., company's special 75-cent dividend will be paid in December, as will its regular quarterly dividend of 5 cents.

Many companies are making special end-of-year dividend payments or moving up their quarterly payouts because investors may have to pay higher taxes on dividend income starting in January.

Investors have paid a maximum 15 percent on dividends since 2003. But that rate will expire in January, rising to as much as 43.4 percent for the highest earners, unless Congress and President Barack Obama reach a deal on taxes and government spending. Even if there is a compromise, there's no guarantee that the tax rate for dividends will remain at its current level.

Movado, which designs watches and runs stores in the U.S., also raised its adjusted profit guidance for the year ending in January to $1.50 per share from $1.40 per share. Analysts polled by FactSet predict earnings of $1.47 per share. The period includes the critical holiday shopping season.

The company still projects revenue of $510 million, in line with analyst expectations.

Net income in the August-October quarter more than doubled, to $34.5 million, or $1.34 per share, from $16.4 million, or 65 cents per share, in the same quarter last year.

The recent quarter's results included a $9.9 million tax benefit. Excluding that, the company said it posted an adjusted profit of 67 cents per share. Analysts expected a profit of 61 cents per share.

Revenue rose 12 percent to $160.2 million from $142.6 million.

Knowledge is power for survival when it comes to overcoming disasters. It is vital to get educated on how to survive in the event of a myriad disaster scenerios. Many people die or get injured because they did not adequately plan, prepare or mitigate for unseen emergencies. In order to win the war on disasters; American citizens must take disaster preparation seriously and strengthen themselves mentally, spiritually, and physically to overcome the challenges in the future.

The Federal Emergency Management Agency states on their website that there are actions that should be taken before, during, and after an event that are unique to each hazard. Each person or group should identify the hazards that have happened or could happen in their area and plan for the unique actions for each hazard. They further note that mitigation can be defined as actions to reduce loss of life and property by decreasing the impact of disasters.? What this means is??taking action now??before the next disaster?to reduce human and financial consequences later (analyzing risk, reducing risk, insuring against risk).? Effective mitigation requires that we all understand local risks, address the hard choices, and invest in long-term community well-being. Without these actions, people jeopardize their safety, financial security, and self-reliance and quality of life.

Building an emergency kit with first aid equipment and taking medical classes are best practices in mitigation that can assist in reducing risk and loss to families and the community.? It is important to analyze what type of hazards would affect the community during a disaster, as well the decision to shelter in place or evacuate to a safe location.? By following this risk analysis process, it would help clarify what type and size of container or bag to place first aid items inside, the quantity, what too and what not to pack, where to pack it, the environment, hazard scenario and number of people it can provide care too. Your first aid kit or emergency supplies should be designed around an all hazards approach that insures against the risk of not being able to treat or prevent hazards from overtaking you and your group. These hazards can cause temporary or permanent damage to the critical infrastructure of this nation. Therefore everyone should be a stakeholder in public safety and security of this nation. As a result, many are designing their first aid kits around temporary disaster events where there is a short recovery period, while others are preparing their kits for a total collapse of the system where medical resources will be hard to find.

Caution: for medical legal and health safety reasons-Disaster Preparers should think about:

  1. Preparing physically, mentally, and spiritually now to adapt to changes caused by impact of disasters and?continuity of civil and infastructure recovery.
  2. Familiarizing with their local, state and federal laws on the boundaries of giving care to humans, pets and livestock.
  3. Getting prior training on how to use the items in the first aid kit.
  4. Working as a trained and covenant group, not loner.
  5. Trying to get written certification or medical authority to perform certain procedures.
  6. Not going beyond their scope of practice or their medical certifications.
  7. Abiding by the local laws of what is allowed in your first aid or medical kit.
  8. (Personal, Force, Asset?Protection)Avoiding making themselves a target for thieves, murderers, drug addicts that use false emergency scenes or requests for help.

Fiat 500 adds electric and big versions to lineup

DETROIT (AP) ? The Fiat 500 is getting bigger and going electric.

Two new versions of the Italian-styled mini-car are appearing at the Los Angeles Auto Show this week: The "500e" is the brand's first all-electric model in the U.S. while the "500L" comes with four doors and significantly more room than a regular model. The first 500 hit U.S. showrooms two years ago, promising a stylish and fuel-efficient remake of the 1950s original. Since then, at least four variations of the remake have rolled out.

The 500's expanding lineup mimics the successful strategy of another tiny car, BMW's Mini Cooper. The German automaker has broadened the niche car's appeal by offering spins-offs that target more tastes and lifestyles. The 500 also has tried that, offering convertible, luxury and high-performance variations.

The 500 needs to boost its allure in the U.S., where sales remain pint-sized compared with the rest of the world. Fiat has produced more than 1 million 500s worldwide since the car's global launch in 2007, but acceptance has been slow in the U.S., where just over 36,000 500s have been sold through October.

Here are some highlights of the car:

UNDER THE HOOD: The 500e has a lithium-ion battery that powers a 111 horsepower electric motor. The battery can be recharged in less than four hours with a 240-volt charging station. The car will be able to go 80 miles before its battery has to be recharged, with driving range in the city exceeding 100 miles, according to Fiat, which also runs Chrysler Group LLC. Electric cars and hybrids, in general, have better range in the city because their brakes generate power to recharge the battery. The 500L will have a 160-horsepower 1.4-liter turbocharged four-cylinder engine. There's a choice of manual or automatic six-speed transmissions.

OUTSIDE: Engineers made the 500e more aerodynamic than the current 500, improving its wind drag statistics by 13 percent. The electric version gets sculpted new front and rear fascias that were designed by using a wind tunnel. It also has a hatch-mounted spoiler. The 500e suspension is new for the electric car, giving it better handling. The L is 26 inches longer and 6 inches wider and taller than the current 500 and will come with four doors instead of two.

INSIDE: The 500e gets a 7-inch dashboard screen with graphics to show battery charge levels and other functions. The five-passenger 500L gets so much more interior space that it's considered a large car, the company says. The interior is 42 percent bigger than a regular 500, which seats four, Chrysler says.

FUEL ECONOMY: The 500e will get the equivalent of 116 miles per gallon of gasoline in the city and 100 mpg on the highway, Chrysler says. The 500L gas mileage hasn't been announced yet, but here's a benchmark: The "Abarth" sport version of the car, which has the same engine as the 500L, gets 28 mpg in the city and 34 on the highway with a five-speed manual transmission.

PRICE: Not announced yet for either model. The 500e will be sold only in California at first, starting in the second quarter of 2013. Chrysler won't say where it will go next. The 500L will come out in the middle of next year in all of North America.

CHEERS: The 500e offers decent range on electricity with cute European styling. The 500L has the style, plus room for more people and stuff, which should expand the mini-car's market.

JEERS: The electric car is going only to California, at least for the moment. It also faces plenty of competition from other electrics, such as the Chevrolet Volt, Nissan Leaf, Ford Focus and Mitsubishi i. If the 500L doesn't get any better gas mileage than the Abarth, it will be behind many other small cars on the market.

Microbial 'missing link' discovered after man impales hand on tree branch

ScienceDaily (Nov. 26, 2012) ? It all started with a crab apple tree. Two years ago, a 71-year-old Indiana man impaled his hand on a branch after cutting down a dead tree. The wound caused an infection that led scientists to discover a new bacterium and solve a mystery about how bacteria came to live inside insects.

On Oct. 15, 2010, Thomas Fritz, a retired inventor, engineer and volunteer firefighter, cut down a dead, 10-foot-tall crab apple tree outside his home near Evansville, Ind.

As he dragged away the debris, he got tangled in it and fell. A small branch impaled his right hand in the fleshy web between the thumb and index finger.

A former emergency medical technician, Fritz dressed the wound, which became swollen. Then he waited for a scheduled visit with his doctor a few days later. By then, a cyst formed at the wound site. The doctor put Fritz on an antibiotic after sending a sample of the cyst to a lab.

The pain and swelling persisted and the wound became abscessed.

About five weeks after the accident, an orthopedic surgeon removed several pieces of bark from the wound, which finally healed without further incident.

Only later did Fritz find out that his infected wound contained a previously unknown bacterium that scientists say could be used to block disease transmission by insects and prevent crop damage.

Scientists call the new strain human Sodalis or HS; it's related to Sodalis, a genus of bacteria that lives symbiotically inside insects' guts.

The journal PLOS Genetics published a paper detailing the discovery November 26.

"Symbiotic interactions between microorganisms and insects are common, and biologists suspect that they're an important driver of biological diversification," says Matt Kane, program director in the National Science Foundation's Division of Environmental Biology, which funded the research.

"But how such symbioses came to be is often a mystery," Kane says. "This particular story has a happy ending, but also an interesting one, because researchers used it to gain insight into how insects and microbes can form symbiotic partnerships in the first place."

As in the case of the crab apple tree, "there are bacteria in the environment that form symbiotic relationships with insects," says University of Utah biologist Kelly Oakeson, the study's lead co-author. "This is the first time such a bacterium has been found and studied."

Identifying a New Strain of Bacteria

The lab that first received the sample from Fritz's infected wound couldn't identify the bacterium once it was isolated. So the organism was shipped to ARUP Laboratories, a national pathology reference library operated by the University of Utah.

An automated analysis at ARUP found that the bacterium from Fritz was E. coli, but scientists doubted the results.

"We had close matches for it, but none were validly described species," says Mark Fisher of the ARUP Institute for Clinical and Experimental Pathology and a co-author of the paper. "It caught my eye because I knew Colin Dale worked on Sodalis."

Dale is the researcher who discovered and named Sodalis in 1999. He is a biologist at the University of Utah and is the study's senior author.

He says that genetic sequencing showed that the HS bacterium is related to bacteria that live symbiotically in 17 insect species, including tsetse flies, weevils, bird lice and stinkbugs, and is most closely related to bacteria in the chestnut weevil and a stinkbug species.

The study compared HS with genomes of the strain Sodalis glossinidius that lives in tsetse fliesand another Sodalis-likebacterium that lives in grain weevils.

Compared with HS, the other two bacterial species have lost or deactivated about half their genes.

A Missing Link

According to Dale, the findings provide "a missing link in our understanding of how beneficial insect-bacteria relationships originate.

"They show that these relationships arise independently in each insect. The insect picks up a pathogen that is widespread in the environment and then domesticates it. This happens independently in each insect."

A competing theory is that parasitic wasps and mites spread symbiotic bacteria from one insect to another.

Dale says that theory cannot explain why such similar types of Sodalis bacteria are found in insects that differ widely in location and diet, including insects that feed either on plants or animals.

The new results support the theory that insects are infected by pathogenic bacteria from plants or animals in their environment, and that the bacteria evolve to become less virulent and to provide benefits to the insect.

Then, instead of spreading from one insect to another, the bacteria spread from mother insects to their offspring.

Taming Invading Bacteria

Various bacteria live symbiotically in blood or fat cells or in special structures attached to the guts of as many as 10 percent of all insects.

The bacteria gain shelter and nutrition from their insect hosts, and they produce nutrients--B vitamins and amino acids--to help feed the insects.

Sometimes they also produce toxins to kill invaders, such as fungi or the eggs laid in an insect by a parasitic wasp.

Sodalis is only one of several types of bacteria that live in insects.

Symbiotic bacteria are known for having the smallest genetic blueprints, or genomes, of any cellular organism because as they evolve inside an insect, they lose genes that would be needed for survival outside the insect.

But when biologists sequenced the new bacterium's genome, they found that HS has a relatively large genetic blueprint and is closely related to Sodalis-like bacteria that have smaller genomes and live in many species of insects, implying that Sodalis-like bacteria all descended from a bacterium like HS.

A Way to Block Some Insect-Spread Diseases?

The researchers believe the discovery could have important implications. They say it may be possible to genetically alter the new bacterium to block disease transmission by insects like tsetse flies and prevent crop damage by insect-borne viruses.

"If we can genetically modify a bacterium that could be put back into insects, it could be used as a way to combat diseases transmitted by those insects," says Adam Clayton, a University of Utah biologist and lead author of the paper unveiling the new bacterium and its genome.

Tsetse flies and aphids both carry symbiotic Sodalis bacteria related to strain HS. Sodalis doesn't grow well outside insects, but HS grows well in the lab.

So it may be possible to insert genes in HS, and then place the bacteria in tsetse flies to kill the protozoan parasites that live in the flies and cause sleeping sickness in people and domestic animals in Africa.

Aphids transmit many plant viruses that attack soybeans, alfalfa, beets, beans and peanuts.

Replacing their normal symbiotic bacteria with a genetically engineered strain of HS could interfere with disease transmission.

The researchers speculate that in addition to the HS bacterium, there are likely many other undiscovered bacteria in the environment that could form symbiotic relationships with insects.

"We have identified very few of the bacteria that exist in nature," says Dale, "and new species and strains like HS are often only discovered when they infect humans."

Additional co-authors of the paper are Maria Gutin, Arthur Pontes, Diane Dunn, Andrew von Niederhausern and Robert Weiss, all of the University of Utah.

The National Institutes of Health also funded the research.

Ericsson Sues Samsung Over Wireless Patents

Ericsson is the latest to file a patent suit against Samsung after the?Swedish telecoms firm accused the Korean electronics giant of refusing to sign FRAND (Fair, Reasonable and Non-Discriminatory)?licensing agreements despite two years of negotiation.

?Ericsson has concluded that it has no option other than legal action after negotiations have not been successful since Samsung has refused to take a license on FRAND terms,??a company statement read.

The company says that the issue centers around one of its patented technologies that is ?essential?to several telecommunications and networking standards used by Samsung?s products?, in addition to other technologies that it claims are used in wireless and consumer electronics products.

FRAND licensing is typically used to license patents and technologies that have become essential, often for or as an industry standard. They are designed to stop monopolies, the idea being that a FRAND licensed technology can be offered to any company or group wanting to use it.

The growth of patent suits has added complication to FRAND licensing and Apple, for one, has reached out to industry bodies for greater clarification and change. In a letter to?the?European Telecommunications Standards Institute?(ETSI) in February, it is?said to have proposed suggestions to set royalty rates that all members of the ETSI would follow, in response to cases where inflated and unreasonable terms and prices have been proposed by patent owners.

Samsung was on the receiving end of a landmark decision when a US court decision handed it a fine of more than $1 billion?after?Apple won a key U.S. patent case. The Cupertino firm itself suffered a significant recent loss and $368 million fine as patent specialist VirtnetX won a Texas case against it, but Apple did end its ongoing feud with HTC as the two signed a 10-year licensing agreement this month.

Samsung told media it has no intention of striking a similar deal, despite the threat of US sales injunctions looming. Now it has one further case to concern itself with.

Update: Samsung has responded with the following statement:

?Samsung and Ericsson have previously negotiated and entered licensing deals. Now that the deal has to be renewed, we have faithfully committed ourselves to conducting fair and reasonable negotiations with Ericsson over the past two years, but this time Ericsson has demanded prohibitively higher royalty rates for the same patent portfolio.

?As we cannot accept such extreme demands, we will take all necessary legal measures to protect against Ericsson?s excessive claims.?

I became a "Mac person" in 2010 and, over the past two years, I have learned that as much as I love my Mac and think it's better than a PC, I've had to get used to not being able to do things that PC users can do.? Sometimes it can make me feel a little like a second class citizen, but generally I remain convinced that what I have is better.? Until I encountered the Happauge HD PVR 2 Gaming Edition I had never, as a PlayStation 3 user, felt second class to a 360 user (keep your snide remarks to yourself 360 fans).? And, my problems with the device are only exacerbated by being a Mac person.

Happauge's recently released their HD PVR 2 Gaming Edition is a little square box that you place in line between your HD gaming console and your TV. ?You then hook it up to your computer via USB and, voila, you can record an HD snippet of your game using the H.264 format. ?A blue light is emitted from the HD PVR 2 upon it going live, and a green light when it records.

Why would you want to do this?? To show friends how awesome you are, because you're putting together a little how-to on going through a level, or because you're writing a review and it would help to have a clip showing what you're talking about.

If you run an XBox 360, it all works like magic ? HDMI out to the HD PVR 2 and then out from the HD PVR 2 to your TV or surround sound system.?

Things are more complicated on PS3.? Due to copy protection on the PS3, an HDMI out to a recorder isn't the simplest of affairs and so the HD PVR 2 opts to use component video cables to make the connection.? The loss, video-wise, really isn't anything to speak of if you're putting together web videos, but the problem comes in with the audio to your TV (and the recommended downgrade from 1080p to 1080i).? The HD PVR 2 won't accept the audio portion of the HDMI PS3 feed nor will it take the PS3's optical out, so you're left having to run the stereo RCA jacks from the PS3 into the HD PVR 2.? Happily, the HD PVR 2 will still run those signals out on an HDMI cable into your TV or surround sound system? but it won't be surround sound, it'll be stereo (a call to Happauge's tech support line confirmed this limitation).

(AP) ? Finance ministers from the 17 European Union countries that use the euro are trying to hammer out a deal Monday in Brussels on the desperately needed next installment of bailout money for struggling Greece.

The ministers have failed twice in the last two weeks to reach an agreement them to release some ?44 billion ($56.8 billion) for the cash-strapped country.

But Greece is already living on borrowed time ? it still owes money it was supposed to repay last week.

On his way into the meeting, Olli Rehn, the EU's top financial official, said it was important for the ministers and Greece's international creditors including the International Monetary Fund to agree on a deal. Distributing the next batch of bailout money was essential, he said, "in order to end the uncertainty that's still hanging over Greece. It's important for Greece, important for Europe."

"I want to encourage all the euro area member states and the IMF to go the last mile to find an agreement ? in fact to go the last centimeter, because we are so close," Rehn said. "Greece has delivered. Now it is the delivery time for the eurogroup and the IMF."

In return for its bailout loans, Greece has had to impose several rounds of austerity measures and submit its economy to scrutiny from the so-called troika of the IMF, European Central Bank and European Commission.

Greece's fortunes are inextricably tied to the rest of the eurozone. Without the bailout funds that have been keeping it afloat since May 2010, the country would default and could end up having to leave the eurozone. This could have a domino effect on other financially troubled eurozone nations.

Greece is unlikely to complete its program of budget cuts and reforms by 2014. For this reason, it is likely to be given an additional two years by the so-called troika of international lenders, composed of the IMF, the European Central Bank, and the European Commission, which is the executive arm of the 27-country European Union.

But that extension will cost several billion more, and it is disagreements over how to fund this that have stopped Greece from getting its money.

"There have been disputes in recent weeks among the members of the troika," said Craig Erlam, an analyst at Alpari. "However these are expected to be resolved today, meaning Greece will finally receive the next bailout payment. If not, Greece could run out of money in the coming days, the consequences of which could be disastrous for the eurozone."

Several proposals have been floated as ways to plug the financial hole. These include reducing the interest rate Greece pays on its loans from euro partners, lenders such as the ECB giving up interest or profit on their loans, a debt buyback that would reduce the country's burden in the long term, and debt forgiveness by some other countries in the eurozone.

But most of those solutions involved dipping once again into the pockets of taxpayers ? something that has become increasingly unpalatable politically.

The troika partners also disagree on whether Greece should be given an extra two years, to 2022, to bring its debt down to 120 percent of gross domestic product from the 176 percent forecast for this year. The IMF has resisted such an extension.

The ministers hope to reach a political agreement Monday. That agreement will have to be submitted to national parliaments in some countries. After that, the finance ministers plan to hold another meeting, either in person or by telephone, to give final approval to the disbursement.

ConocoPhillips to sell Kazakh oilfield stake to India's ONGC for $5 billion

(Reuters) - ConocoPhillips said it plans to sell its 8.4 percent stake in Kazakhstan's giant Kashagan oil field to India's Oil and Natural Gas Corp Ltd for about $5 billion as the Indian company looks to make up for flagging production.

Kashagan, the world's biggest oilfield discovery since 1968, holds an estimated 30 billion barrels of oil-in-place, of which 8-12 billion are potentially recoverable. First production from the field is expected in 2013.

India, the world's fourth-biggest oil importer, buys nearly 80 percent of its oil needs as expanding refining capacity has outpaced local oil output. State-run ONGC's local oil output has been almost stagnant for years.

ConocoPhillips said the carrying value of the assets related to its Kashagan interest was about $5.5 billion as of September 30.

The company said it would take an after-tax impairment of about $400 million in the fourth quarter to reduce the carrying value. The deal is expected to close in the first half of 2013.

ONGC, India's third-biggest company by market value, has been investing to maintain output from its old fields and has capital spending plans of around 340 billion Indian rupees ($6.12 billion) both this year and next. The company is under pressure from the government to meet rising demand.

The acquisition is the largest ever for ONGC, and marks the biggest outbound deal from India since mobile phone operator Bharti Airtel bought mobile phone operations in 15 African countries for $9 billion in 2010 from Kuwait-based telecoms group Zain .

ONGC Videsh, the arm of ONGC that invests in overseas assets, said the acquisition would likely add 1 million tonnes (20,000 barrels per day) to its annual production over 25 years with the company's share of output significantly higher in later stages of development. ONGC Videsh's production in the year to March 31, 2012 was 8.7 million tonnes.

Kazakhstan, home to 3 percent of the world's recoverable oil reserves and the largest former Soviet oil producer after Russia, has sought to revise deals struck with foreign energy companies in the lean post-Soviet years.

ConocoPhillips has been conducting a disposal program to reduce its non-core overseas assets to reduce debt and increase its exploration and dividend budgets.

It has already exceeded its target of asset sales worth $20 billion by the end of 2012, including the sale of its stake in Lukoil , Russia's second-biggest oil producer.

"(The) purchase price of $5 billion is at the high end of our prior expectation of $4 to $5 billion," analysts at Simmons and Co wrote in a note to clients.

"This is a positive for ConocoPhillips as it marks important progress on their asset divestiture program, which is needed to support the capital program and dividend."

ConocoPhillips shares down slightly at $56.39 in early trading.

The company said it notified government authorities in Kazakhstan, and its partners in the North Caspian Sea production-sharing agreement of its intention to sell the stake.

Kazakh Oil and Gas Minister Sauat Mynbayev last month disclosed ConocoPhillips' plans to sell its stake in the field.

The Kashagan field is jointly controlled by state-run KazMunaiGas and six international companies, including Eni Spa ExxonMobil Corp , Royal Dutch Shell Plc , Total SA and Inpex Corp .

(AP) ? Gene Chizik led Auburn to a historic season but couldn't keep the Tigers from descending to their lowest point in decades.

The rapid fall from a national championship to 3-9 and the Southeastern Conference doormat led to Chizik's firing Sunday, the day after a humbling 49-0 loss to No. 2 Alabama that showed just how far the program has fallen.

The Tigers endured the worst slide within two years of winning a national championship of any team since the Associated Press poll started in 1936 and hadn't lost this many games since going 0-10 in 1950. The decision came 17 months after Auburn gave Chizik a contract worth some $3.5 million annually through 2015 with a hefty buyout.

Auburn athletic director Jay Jacobs said he informed Chizik Sunday morning after President Jay Gogue accepted his recommendation to fire the coach.

The players were informed in a team meeting Sunday. Jacobs scheduled a news conference for later in the afternoon.

"I'm extremely disappointed with the way this season turned out and I apologize to the Auburn family and our team for what they have had to endure," Chizik said in a statement released by Auburn. "In my 27 years of coaching, I have gained an understanding of the high expectations in this profession. When expectations are not met, I understand changes must be made."

The Tigers went from 14-0 with a perfect SEC record with Cam Newton leading the offense in 2010 to 3-9 and 0-8, losing their final three league games by a combined 150-21. Auburn was blown out by Texas A&M (63-21) and Georgia (38-0) but the finale was even more painful for Tigers fans.

The Crimson Tide cruised to a six-touchdown halftime lead and the second-most lopsided Iron Bowl victory in history, behind only the Tide's 55-0 win in 1948.

"While we experienced a tremendous low in 2012, I will always be proud of the incredible highs that we achieved, including three bowl victories, an SEC championship and a national championship," Chizik said.

He was 33-19 in four seasons and 15-17 in SEC games.

Auburn said the total buyout for Chizik and his assistant coaches is $11.09 million. Chizik's buyout is expected to total $7.5 million and will be paid in monthly installments for the next four years.

Six assistants are under contract through June 30, 2013 while defensive coordinator Brian VanGorder, offensive coordinator Scot Loeffler and wide receivers coach Trooper Taylor have deals extending another year beyond that.

The buyouts could be reduced if the coaches find other jobs.

Auburn joins Arkansas, Tennessee and Kentucky as SEC teams with job openings showing the huge divide in a league with six teams ranked in the Top 11.

Auburn tight end Philip Lutzenkirchen said players gave Chizik a warm ovation after the team meeting.

"I think we did what he deserved and we gave him a standing ovation and clapped for him," he said. There's so much love for coach Chizik on this team. Would we have loved to see him get another year, another opportunity? Yes, but at the same time we understand where Jay Jacobs is coming from. Three wins isn't going to cut it in our league."

Defensive tackle Jeff Whitaker said, "It's kind of crazy right now. I had a special bond with Coach Chizik."

Chizik inserted tailback Tre Mason on the final play against Alabama to get him to 1,000 yards. The next day, Mason saw his coach get fired.

"It was a rough day for everybody," Mason said. "It's tough. There are going to be a lot of tears shed because there are a lot of relationships that may be put on hold or come to an end today. I have nothing negative to say about coach Chizik. He's done a lot for me and this program. I wish him the best of luck in his future."

Chizik had sandwiched two 8-5 seasons around the national title, but never approached the success of 2010, when Newton won the Heisman Trophy. The Tigers were 7-17 in SEC games outside of 2010 during his tenure.

His hiring was criticized by some fans after Chizik went 5-19 in two seasons at Iowa State and lost the last 10 games of his first head coaching job.

Jacobs was heckled at the airport after making the hire.

Chizik had been defensive coordinator on unbeaten teams at Auburn and Texas.

A search committee comprised of former Heisman Trophy winners Pat Sullivan and Bo Jackson and former Tigers fullback Mac Crawford will assist Jacobs, the school said.

A transition year might have been expected.

Chizik had to replace the offensive and defensive coordinators after last season. Chizik made an ill-fated switch from Gus Malzahn's no-huddle, spread offense to a pro-style system with the hiring of former Temple offensive coordinator Scot Loeffler.

The Tigers struggled in the transition, partly because of shaky quarterback play and ended the season with freshman Jonathan Wallace under center.

Auburn ranked at or near the bottom of the SEC in every major statistical category offensively and defensively.

Chizik's tenure was marred by off-the-field problems, too, to the extent that he had employees of a private firm run curfew checks on players this season.

Four members of the 2010 national championship team were arrested on robbery charges in March 2011. Antonio Goodwin was convicted in April and sentenced to 15 years in prison. Dakota Mosley, Michael McNeil and Shaun Kitchens are awaiting trial.

Two-time 1,000-yard rusher Mike Dyer transferred to Arkansas State with Malzahn after being indefinitely suspended before the bowl game.

Freshman quarterback Zeke Pike was arrested in June for public intoxication and later dismissed from the team. Starting center Reese Dismukes was suspended for the opener against Clemson following a public intoxication arrest.

Auburn is also the subject of an NCAA investigation that includes the recruitment of Memphis running back Jovon Robinson, who was ruled ineligible after a guidance counselor admitted to creating a fake transcript.

The Birmingham News reported on Wednesday that NCAA investigators had interviewed at least one assistant coach and several players during the week leading up to the Iron Bowl.

Chizik's contract includes a clause that it wouldn't owe the buyout money if he is fired for cause, including findings of major rules violations or significant or repetitive violations" involving him or his program.

Chizik and Auburn have weathered past NCAA scrutiny. The governing body closed investigations into the recruitment of Newton and allegations from four former players that they were paid thousands of dollars during their college careers.
